Trademark Registration in Sri Lanka

Sri Lanka's National Intellectual Property Office (NIPO) manages the country's trademark registration system. Given the geographic proximity and strong trade relationships between India and Sri Lanka, many Indian businesses — particularly in textiles, tea, construction, and consumer goods — need trademark protection in the Sri Lankan market. Sri Lanka follows a first-to-file system and is a member of the Paris Convention and the TRIPS Agreement, but notably is not a member of the Madrid Protocol. This means a direct national filing is required. Registration is valid for 10 years and is renewable indefinitely. The examination and publication process typically takes 6 to 12 months. For Indian brands already exporting to Sri Lanka or planning to establish a presence, early registration prevents local competitors from blocking your entry.

Any individual, partnership firm, LLP, private limited company, or corporate entity—whether domestic or foreign—is eligible to apply for trademark registration in Sri Lanka. For foreign applicants (including Indian businesses), the application must be submitted through a registered local agent or attorney, or designated internationally under the Madrid Protocol. A pre-existing trademark in India is not mandatory for a direct national application, but is required if you are utilizing the Madrid Protocol route. The mark must be distinctive, non-descriptive, and not conflict with any pre-existing registered trademarks or pending applications in Sri Lanka.
